Acceptance of Terms
By downloading, installing, or using the Habinaut mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Description of Service
Habinaut is a habit tracking application with gamification features. The App allows you to track daily medications and supplements, workouts, and custom habits. Completing tracked items generates experience points that fuel a virtual alien civilization game.
Health and Medical Disclaimer
THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.
- Habinaut is a personal tracking and organizational tool only
- The App does not diagnose, treat, cure, or prevent any disease or medical condition
- Medication and supplement tracking is for personal organizational purposes only and should not be relied upon as your sole reminder system
- Always consult a qualified healthcare provider before starting, stopping, or changing any medication, supplement, or exercise regimen
- The predefined medication and supplement library is provided for convenience only and does not constitute a recommendation to take any specific substance or dosage
- Habinaut LLC is not responsible for any health outcomes resulting from the use or misuse of this App, including missed doses or incorrect tracking
- In case of a medical emergency, contact emergency services immediately — do not rely on this App
Account Registration
You must create an account to use the App. You are responsible for:
- Providing accurate account information
- Maintaining the security of your account credentials
- All activity that occurs under your account
User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to other users' data
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Use the App to store information about other people without their consent
Intellectual Property
The App, including its design, code, artwork, game mechanics, and content, is owned by Habinaut LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
In-App Purchases
The App may offer optional cosmetic purchases. All purchases are:
- Final and non-refundable, except as required by applicable law or Apple/Google refund policies
- Cosmetic only — purchases never affect game progression speed, experience point generation, or any gameplay mechanics
- Processed through Apple's App Store or Google Play Store, subject to their respective terms
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The App will be uninterrupted or error-free
- Notifications will be delivered on time or at all
- Data will not be lost
- The App will meet your specific requirements
Limitation of Liability
To the maximum extent permitted by law, Habinaut LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to missed medication doses or reminders, incorrect health or wellness tracking, loss of game progress or data, and any health-related outcomes.
Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.
Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us at support@habinaut.com.
Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the App. Your continued use after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Collin County, Texas.
